Privacy Policy

BrightMinds Software Inc. ("BRIGHTMINDS") respects the privacy of all its website visitors and has established a Privacy Policy whose purpose is to describe how we collect, use, disclose and store your information.  

1. What is Personal Information and what is not Personal Information

Personal information refers to any information that can be used to uniquely identify, or communicate with, an individual. Typically this information includes a person's name, date of birth, home telephone number, home address, personal email address, etc. 

Personal information does not include data such as an individual's business contact information including a position name or title, business phone number, business address, business email address, etc.

2. Collections and use of Personal Information

Should you chose to sign-up to one of BRIGHTMINDS's programs, you will be asked to enter your personal information such as your first name, last name and personal email address so that we may be able to properly identify and communicate with you, and to allow you access to our services.

Should your sign-up in our referral program result in you being remunerated, BRIGHTMINDS may also request additional personal information such as your home address, home telephone number and Social Insurance Number (SIN) / Social Security Number (SSN) or business registration and taxation information, as required by government regulations.  BRIGHTMINDS will also use your personal information to send important notices such as information about remuneration owed or changes to agreements and policies.  As these communications are an important part of your interaction with BRIGHTMINDS, you may not opt out of receiving them.

BRIGHTMINDS may also use personal information for internal purposes such as auditing, data analysis and research to improve our products, services, and communications.

3. Retention and Storage of Your Personal Information

BRIGHTMINDS retains your personal information for as long as necessary to fulfill the purpose(s) for which it was collected and to comply with applicable laws, and your consent to such purposes(s) remains valid after termination of our relationship with you.

BRIGHTMINDS makes commercially reasonable efforts to ensure that personal information collected from you is protected against loss, theft and unauthorized access. Access to your personal information is restricted to select employees or representatives. In addition, BRIGHTMINDS employs generally accepted information security techniques, such as firewalls, access control procedures and cryptography, either directly or indirectly, to protect personal information against loss and unauthorized access.

4. Disclosure of Personal Information

BRIGHTMINDS will not sell, license, trade or rent your personal information to, or with others, without your consent. 

BRIGHTMINDS may share information provided by you with service providers / contractors or partners that we retain to perform services on our behalf.  These contractors or partners are contractually bound through a confidentiality agreement  from using or disclosing the information except as is necessary to perform their services or to comply with legal requirements.  BRIGHTMINDS may also disclose information about you where we are required or permitted to do so by law.

In the case of information provided by contractors, BRIGHTMINDS may share non personal information with its clients or partners in order to expedite the process of matching a contractors qualifications with its clients' or partners' needs.  In these cases, only BRIGHTMINDS will be able to identify the contractor and will remain the sole point of contact between the contractor and the client or partner until such time as the contractor consents to sharing this information.

5. Cookies and Technology

BRIGHTMINDS website and email messages use "cookies" and other technologies such as pixel tags and web beacons.  Cookies are identifiers that are transferred to your computer through your web browser to enable our systems to recognize your browser.  You may choose to disable cookies on your computer by modifying your web browser.  

These technologies help us better understand user behaviour, indicate which parts of our website are visited, whether emails have been read, and facilitate and measure the effectiveness of advertisements and web searches. Information collected by cookies and other technologies are treated as non-personal information. 

In some of our email messages, such as invitations, we use a "click-through URL" linked to content on the BRIGHTMINDS website. When someone clicks one of these URLs, we track this data to help us determine who requested the invitation and measure the effectiveness of our communications. If you prefer not to be tracked in this way, you should not click text or graphic links in the email messages or copy and past them in your browser.

Like most other websites, BRIGHTMINDS may also use logs to collect information about its visitors.  This information includes Internet Protocol (IP) addresses.  In instances of assumed criminal malfeasance, this data can be used to trace and identify individuals and would be shared with appropriate investigative bodies authorized to investigate such breaches of security.

6. Consent and Changes to this Privacy Policy

BRIGHTMINDS uses and collects personal information by fair and lawful means and only with the consent of the individual, except where permitted or required by law.  By using this web site, you consent to the collection, use and disclosure of your personal information by BRIGHTMINDS in the manner described in this Privacy Policy.  BRIGHTMINDS reserves the right to modify this Privacy Policy at any time and without notice to reflect changes in legal obligations or in the manner in which we deal with personal information.

7. Children

BRIGHTMINDS does not knowingly collect personal information from children under the legal working age.  If we learn that we have collected the personal information of a child under the legal working age we will take steps to delete the information as soon as possible.
